Rücktritt / Umbuchung / Stornierung und Aufenthaltsabbruch/ Kündigung des Mieters
(1) Sofern der Eigentümer über entsprechende Kapazitäten verfügt, kann der Mieter den bestehenden Mietvertrag ändern/ umbuchen( z. B. den Termin).
(2) Der Mieter kann vor Mietbeginn jederzeit schriftlich vom Mietvertrag zurücktreten.
Tritt der Mieter vor Mietbeginn vom Mietvertrag zurück, ohne einen Nachmieter ( bei Vorliegen besonderer Gründe in der Person des Ersatzmieters darf die Vermietung abgelehnt werden ) zu benennen, der in den Vertrag zu denselben Konditionen eintritt, sofern eine anderweitige Vermietung nicht möglich ist sind als Entschädigung unter Anrechnung der ersparten Aufwendungen die folgenden anteiligen Mieten (ausschließlich der Endreinigung & Kurtaxe) zu entrichten (mindestens jedoch € 50,00 ):
a. Rücktritt bis zu 90 Tage vor Mietbeginn: 05 % des Mietpreises
b. Rücktritt ab dem 89, bis zum 30. Tag vor Mietbeginn: 20 % des Mietpreises
c. Rücktritt ab dem 29. bis zum 14. Tag vor Mietbeginn 30 % des Mietpreises
d. Rücktritt ab dem 13. bis zum 07. Tag vor Mietbeginn 50 % des Mietpreises
e. Rücktritt ab dem 6. Tag vor Mietbeginn 100 % des Mietpreises
Der Eigentümer ist bemüht, das Mietobjekt anderweitig zu vermieten. Bei ggf. erfolgreicher anderweitiger Vermietung fällt generell eine Bearbeitungspauschale i. H.v. € 50,00 zu Lasten des zurückgetretenen Mieters an, die von den bereits geleisteten Zahlung/en in Abzug gebracht werden.
Dieses gilt ebenfalls bei Minimierung der Gesamt – Personenzahl ( altersunabhängig), die bei Mietvertragsabschluss durch den Mieter angemeldet und somit im Mietvertag eingebucht wurden.
(3) Bricht der Mieter den Aufenthalt vorzeitig ab, ohne dass ein vom Eigentümer wegen grober Pflichtverletzung zu vertretender außerordentlicher Kündigungsgrund vorliegt, bleibt er zur Zahlung des vollen Mietpreises verpflichtet.
(4) Die Rücktritts- oder Kündigungserklärung kann nur schriftlich erfolgen. Maßgeblich ist der Tag des Zugangs der Erklärung bei dem Eigentümer bzw. seines Vertreters.
Bei Nichtanreise ohne Ankündigung wird das Ferienhaus 24 Stunden nach dem Anreisetermin wieder zur Vermietung frei gegeben. Ein Recht auf Bezug des Objektes besteht dann nicht mehr.
