Tritt der Kunde von dem Vertrag zurück oder tritt er den Aufenthalt nicht an, so kann DC Ersatz für die von DC getroffenen Vorkehrungen für den Ferienhausaufenthalt und für DC’s Aufwendungen verlangen. Bei Berechnungen des Ersatzes sind gewöhnlich ersparte Aufwendungen und die gewöhnlich mögliche anderweitige Verwendung der Leistung zu berücksichtigen. Es bleibt dem Kunden unbenommen, den Nachweis zu führen, dass im Zusammenhang mit dem Rücktritt oder Nichtantritt des Ferienhausaufenthaltes DC kein oder ein wesentlich geringerer Schaden entstanden ist, als die von DC in der Pauschale (siehe unten) ausgewiesenen Kosten.
